Act respecting labour standards Chapter V - Recourses (Section 98 to 135)

Chapter V - Recourses (Section 98 to 135)

Division I - Civil recourses (Section 98 to 121)

Section 120

Amount remitted to the commission

After being put in default by the Commission, an employer cannot validly discharge the amounts forming the object of the claim except by remitting them to the Commission. This provision does not apply in the case of an action brought by the employee himself.

1979, c. 45, s. 120.

Interpretation

This provision allows the Commission to make sure that the amount paid by the employer corresponds to the amount actually due to the employee.

As the dispute occurs between the Commission and the employer, the latter must obligatory make payment to the Commission. Any other payment or settlement is not opposable against the Commission.
