Frivolous complaint
The Commission may refuse to proceed with an inquiry if it finds that the complaint is frivolous or made in bad faith.

- Interpretation

The Commission may refuse to proceed with the inquiry when:
- the complaint is frivolous;
The term frivolous refers to something that is unreliable, that is trivial. - the complaint is made in bad faith.
It may involve a case where an employee files a complaint for vengeance and misleads the Commission as to the facts giving rise to the complaint.
