Section 81.4.1
Late delivery
If the delivery takes place after the expected date, the employee is entitled to at least two weeks of maternity leave after the delivery.

- Interpretation

The purpose of this provision is to ensure a leave of at least two weeks for an employee who would have completed her maternity leave due to the fact that her delivery occurred later than anticipated. For example, this would be the case of an employee who reserved two weeks of maternity leave after the anticipated date of her delivery, but who gives birth one week later than expected. She will then be entitled to one additional week of maternity leave.
It should be noted that the employee can always avail herself of the parental leave (s. 81.10 ALS) afterwards.
