Absences of reservists employees

Section 81.17.1 does not apply if the absence of an employee could endanger the life, health or security of other employees or the population or cause the destruction or serious deterioration of certain property or in a case of superior force, or if the absence is inconsistent with the employee’s professional code of ethics.

Interpretation

An employee reservist cannot avail himself of this right to be absent in the following situations:

  1. If the life, health or security of workers or the public is endangered. This principle is already established in section 2 of the Charter of Human Rights and Freedoms (R.S.Q., c. C-12), which confirms the right to assistance for an individual whose life is in peril;
  2. In cases where there is a risk of destruction or serious deterioration of movable and immovable property or in a case of superior force;
  3. If this absence is inconsistent with the employee’s professional code of ethics.
