Chapter IV - Larbour standards (Section 39.1 to 97)
Division II - Hours of work (Section 52 to 59.0.1)
Section 56
Annual leave and statutory general holidays
For the purposes of computing overtime, annual leave and statutory general holidays with pay are counted as days of work.
1979, c. 45, s. 56.
- Interpretation
-
The purpose of this section is to establish a method for computing overtime.
For the purposes of this calculation, the days where the employee is on annual leave as well as statutory general holidays with pay including the National Holiday are considered to be workdays and the corresponding hours are added to the total number of hours actually worked during the week.
It should be pointed out that, for this provision to apply, the employee must necessarily have benefited from a leave. Although he is entitled to an indemnity, this section does not apply to an employee who never works on the day of the holiday.
