Complaint for reprisals relating to pay equity
Workers may file a complaint if they believe that reprisals have been taken against them because they exercised a right provided for in the Loi sur l’équité salariale. Reprisals may include threats, a pay cut or dismissal after a worker filed a complaint against their employer.

How to file a complaint
If you wish to be represented
You may mandate a company, a firm or another person to represent you during the complaint process.
If you are a union member, you may also mandate your union to represent you. In this case, you must provide the name and contact information of a respondent on the complaint form.
We provide a template for a mandate of representation (in French only). You do not have to use it. If you do not use it, you must provide us with the name and contact information of the person appointed to represent you in writing. Check with the person if they accept the mandate you wish to give them.
When the complaint is received
When the complaint is received, the CNESST sends an acknowledgement of receipt to the complainant and examines whether or not the complaint is admissible.
The worker’s consent is required to allow the CNESST to contact the Tribunal administratif du travail and to disclose their identity to their employer and to the person who took the reprisals.
When the file is processed at the Tribunal administratif du travail, the employer will be informed of the reason for the complaint and the worker’s identity. If necessary, Tribunal administratif du travail will take measures for the worker’s benefit.
